Letter to Justice Warren about Senate Testimony on Privacy (1967)

Dear Judge Warren: About ten years ago, in the 1956 issue of Judaism, there was published an article I had written entitled "The Fifth Amendment and its Equivalent in the Halakhah." I was honored to see a reference to this article in your famous Miranda decision of last May. I have the honor, therefore, of sending you enclosed a copy of the testimony I recently delivered before Senator Long's Sub-Committee dealing with the rights of privacy. My testimony, which will be shortly printed in the Proceedings of that Committee, deals with the views of Halakhah (Jewish law) on the Fourth Amendment. I know how terribly busy you are, but I would deeply appreciate receiving any comments you may have to make on this paper. Sincerely yours, Rabbi Norman Lamm

Letter to Lawrence Kobrin about Article on the Fourth Amendment and Halacha (1967)

Dear Larry: Thank you very much for your thoughtful comments on my recent article on the Fourth Amendment. The avenue of investigation which you suggest is interesting. Off-hand, however, I am not aware of any communication that is regarded by the Halakhah as "automatically privileged." The very fact that, as I mentioned in my article, every communication is considered sacrosanct, would seem to make superfluous any special category of "privileged information." Nevertheless, I am putting your letter aside and hope to think about it a bit more systematically, when I return to the city, please God. Letter from Prof. Arnold Enker about Article on the Fourth Amendment and Halacha (1967)

Dear Norm: Thanks for the reprints. They were particularly welcome since I missed both articles because of our stay in Israel. Had I seen the one on the 4th Amendment earlier, I would have worked it into an article I am publishing in the Israel Law Review dealing with electronic eavesdropping. The distinction between aural eavesdropping which can be protected against and other forms of eavesdropping which know no protection seems to me vital. I'll send you a reprint. My best to Mindi.
