It gives me great pleasure to send you the Register of our newly created Department of Jewish Law. I am also enclosing a rather unusual study by one of the young stars of our Department. You should have received by now volumes I and II of our Jewish law journal, Dinei Israel. I am pleased to inform you that volume III is already at the printer’s. A perusal of its contents (on page 20 of the enclosed Register) will show that we have expanded (1) in quantity – it will be larger than volume II, (2) in the level and geography of our contributors – they are no longer limited to the members of our local staff, and (3) in subject matter – we have a larger representation than previously of constitutional law and legal philosophy. May I invite you to join us in volume IV? We would be honored to have you among our contributors, on any topic you deem appropriate, preferably in English (we should like to bolster our English section). I am now engaged in a three-pronged campaign: 1. Recruitment of students either for our Master’s Program or on a one-year-in-Israel basis. לכבוד ד״ר קירשנבאום, פרופ׳ קירשנבאום הינו אחד מיחידי הסגולה שקנה לו שם טוב בכמה עולמות שלא תמיד משיקים זה לזה. קוראי עיוני משפט, וכמו כן דיני ישראל, מכירים את שמו כבר־סמכא ובר־הכי מן המעולים במקצוע של המשפט העברי. בראשית דרכו האקדמית ינק פרופ׳ קירשנבאום משני מקורות מרכזיים – האחד, הרקע התלמודי המסורתי שקנה לו כ״מתמיד״ בישיבות מסורתיות ובמוסדות יהודיים אחרים בארה״ב, והשני, המשפט הרומי שלמד באוניברסיטת קולומביה, שם הוכתר בתואר דוקטור. דרך חינוכו הובילהו, דרך הטבע, לפרוזדור של המשפט ההשוואתי ומשם לטרקלין של המשפט העברי. פרסומיו בעברית ובאנגלית, הן בכתבי עת והן בספרים שלמים, זכו להכרה ולהוקרה אצל המומחים במקצוע. היקף מחקריו כולל: ההרשעה העצמית, שליחות לדבר עבירה, הענישה במשפט העברי הפלילי, המשך ותמורה במשפט העברי, בעיית ״החוק הטבעי״ בהלכה, ריבית, ניתוח המושגים ״לפנים משורת הדין״, ״מפני דרכי שלום״, ״דיני שמים״ ועוד כהנה וכהנה. אבל מעבר לקריירה האקדמית הפורייה שלו, חונן פרופ׳ קירשנבאום במידות אישיות נעלות. הנני מכירו כמעט ארבעים שנה, ולא פגשתי אף אדם אחד שתהיה לו הקפדה, תרעומת או ביקורת אישית עליו. חוט של חן משוך על האיש הזה, והליכותיו הנעימות רכשו לו כבוד ואמון אצל מוריו, עמיתיו ותלמידיו. הנני מנצל הזדמנות זו להוסיף את ברכתי האישית לו, לרעייתו ולמשפחתו. ״עוז וחדווה במקומו״ – רגשות מעורבים פקדוני כשנודע לי שהמשפחה החליטה לעלות ארצה: שמחה, כמובן, להם ולעם היהודי במדינת ישראל, אבל גם דאגה לקהילה היהודית בארה״ב, שאינה עשירה כל כך במלומדים המשלבים תורה ומדע בכלל ובמשפט עברי בפרט. עמדתי בקשר עמו במשך כל השנים, ואף שיתפנו פעולה במחקר וביוזמתו – בראשית כהונתי בישיבה אוניברסיטה הוצאנו לאור מאמר משותף. פעמים רבות הזמנוהו להרצות בבית הספר למשפטים ע״ש קרדוזו שליד ישיבה אוניברסיטה, והרצאותיו נתקבלו בהערכה רבה. פרופ׳ קירשנבאום שימש לי אישית מקור של עצות טובות ומועילות לבעיות חמורות שהן מנת חלקו של נשיא אוניברסיטה בזמננו. מי שעובד באוניברסיטה לשם פרנסה – הפרישה לגמלאות היא סוף פסוק לקריירה שלו. אבל מי שלומד ״לשמה״, לאהבת החכמה – הגמלאות איננה אלא המשך עבודתו בתנאים אחרים. אין לי ספק שבשלב החדש הזה, כשהוא משוחרר מטרדות האקדמיה השוטפות, ימשיך להעשיר את עולם המחקר אף יותר מאשר עד הנה. חז…
