On Bikkur Cholim (1995)

It is a pleasure to greet all of you, and especially the living spirit of this very special group, Rabbi Isaac Trainin. His pioneering work on behalf of Bikkur Cholim as his post-retirement activity is sufficient testimony to his mental and spiritual health as well as to his health-mindedness. More power to him as a role model for all of us as to how to use one's time when the exigencies of career and the need to work for a living have released us from their ubiquitous claims.IIWe all know that bikkur cholim is a mitzvah, a religious commandment in Judaism. But exactly where does it fit into the rubric of the 613 commandments?Its technical categorization by Halakha (Jewish law) is a matter of dispute between two eminent halakhic authorities. One is a great decisor who flourished at the end of the Geonic period and is known as Baal Halakhot Gedolot, the author of a historic work by the name of Halakhot Gedolot ("the great compilation of laws") and is usually referred to by the acronym Behag. The other is the most distinguished name of medieval Sephardic Jewry, R. Moses ben Maimon—Maimonides or the Rambam. Maimonides assigns bikkur cholim to the mitzvah of "thou shalt love thy neighbor as thyself," i.e., bikkur cholim is but one aspect of the more comprehensive injunction to love one's fellow human beings. His predecessor, Behag, however, holds that bikkur cholim is a separate and independent mitzvah, part of the general category of chesed or acts of loving-kindness.We can understand Maimonides: bikkur cholim obviously belongs with the mitzvah of love of fellow humans. But what of the Behag? If indeed bikkur cholim is an aspect of chesed, how does one distinguish between chesed and that other well-known and oft-discussed Jewish precept, tzedakah? If the former means love and concern for humans, is that not identical to the latter—for is not charity given to implement one's feeling of loving concern for the other? טיפול רפואי אם יש בו מצוה (1973)

האם מלאכת הרופא היא מצוה כשלעצמה – גם ללא תלות בהצלחת הטיפול – או שמא ערכה ההלכתי נמדד רק בתוצאותיה? במבט ראשון נראה פשוט שיש כאן קיום מצוה, כפי שעולה ממשנה נדרים ל"ח ע"ב: "המודר הנאה מחברו... מרפאו רפואת נפש, אבל לא רפואת ממון." הריפוי לגופו מותר – משום שמצוה קא עביד, כפי שמובא בירושלמי ובראשונים כהר"ן והרא"ש. לעניין זהות המצוה, הרמב"ם והר"ן מייחסים זאת למצוות השבת אבידה, על פי הספרא: "והשבות לו – אף את עצמו אתה משיב לו." אחרים, כגון השאילתות והרמב"ן, מבססים זאת על "וחי אחיך עמך", ויש גם ראשונים הקושרים זאת ל"לא תעמוד על דם רעך".אלא שהאחרונים העלו קושיה: בשו"ע יו"ד של"ו נפסק שאם רופא טעה והזיק – פטור מדיני אדם וחייב בדיני שמים; ואם המית – גולה. נשאלת השאלה: מדוע גולה? הרי שליח בי"ד, אב ורב שהכו והמיתו בשוגג – פטורים מגלות, כיון שפעלו בשעת עשיית מצוה (רמב"ם, רוצח ה"ה–ו). היד אברהם תירץ: באותם מקרים קיימת מצוה בעצם הפעולה (לימוד, הבאה לדין), גם אם התוצאה הייתה מיתה. לעומת זאת, ברופא – אם החולה מת, לא התקיימה מצוה, ולכן גולה.לפי שיטה זו, מצות הרפואה מותנית בהצלחה; אם הטיפול נכשל – אין קיום מצוה כלל. אך יש לעיין: הרמב"ם מזכיר רק שליח בי"ד ואב ורב כפטורים, ולא רופא, ומכאן שגם הוא סבור שרופא גולה, שהרי לא פעל "בשעת עשיית מצוה". אך ייתכן שהרמב"ם סבור שהרשות לרפא ("ורפא ירפא") נועדה רק להתיר את עצם העיסוק ברפואה, ולא להפוך אותו לחובת מצוה אם לא הביאה תועלת בפועל.לעומת זאת, הרמב"ן בתורת האדם מבאר את הרשות לרפא לא כהיתר הלכתי גרידא, אלא כהסרת חשש – שמא יירתע הרופא מלרפא מפחד אחריות פלילית. כלומר, עצם העיסוק ברפואה הוא מצוה, ומכאן נולדת הרשות. הוא אף מדמה את הרופא לדיין: כשם שעל אף חשש טעות מחויב הדיין לדון, כך הרופא מצֻווה לרפא.המושב זקנים לבעלי התוספות (שמות כ"א:י"ט) מקשה על רש"י ותוס' – אם החשש הוא "רחמנא מחי ואיהו מסי", הרי שגם בהצלה אין לחשוש לסתירת גזירת שמים, והרי שם ודאי חייב לעזור. לכן מפרש ר"ח: הפסוק מלמד שניתנה רשות לרופא גם אם טעה והמית.ראיה לשיטה זו במדרש שמואל: אדם מעיר לרבי עקיבא ורבי ישמעאל על כך שהם מתערבים בבריאת ה' בכך שהם מרפאים. תשובתם: כשם שעובד אדמה חייב לחרוש ולטפח את השדה, אף שה' בראו – כך גם הגוף זקוק לזבל, למים ולרופא. הרופא הוא חלק מהתהליך האלוקי.…

Abi Gezunt (1973)

Our Sidra opens this morning with the revelation of God to Abraham. We are not told what it was that God told the patriarch, but the Rabbis inform us that the Lord, as it were, was performing the commandment of Bikkur cholim, visiting the sick. Abraham was an old man, he had just been circumcised, and he was indisposed. It was at this time of his recuperation that God paid him the visit. Reading of this account affords us the opportunity to speak about the Jewish view of sickness and health, and especially one of the most significant and cherished precepts in the Torah, that of Bikkur cholim, visiting the sick. First, it is unquestionable that health is an important value. Judaism raises shemirat ha-guf, care for the body, to the level of a mitzvah or precept. Maimonides had taught, long before Benjamin Franklin, that a sound mind depends upon a sound body. To deny that health is a great value is to fly in the face of the facts of Jewish teaching. Every four weeks we offer a special prayer at the advent of the new month in which we ask for chilutz atzamot, health, and three times every day we turn to God and pray, refaenu, “Heal us, O Lord.” Those who suffer from illness, either themselves or in their families, can surely appreciate the great blessing that good health is.And yet, I question the implicit prejudice of many uninformed and semi-informed people that health is Judaism’s chief value. Thus, for instance, they interpret the laws of Kashrut and Mikvah as primarily hygienic regulations, when in fact they are not such.Furthermore, we are all acquainted with the Yiddishism, “Abi Gezunt” – as long as you are well. You've lost a fortune? – “Abi Gezunt.” You failed a crucial test? – “Abi Gezunt.” You are getting a divorce and breaking up your home? – “Abi Gezunt.” Your children are marrying out of the faith? – “Abi Gezunt.”“Abi Gezunt” is based upon a philosophical assumption which I deny, namely, that health is the highest value.
