Harmony and Integrity (1989)

I was uncertain what to talk about… so, bedi’leita beraira, I decided to speak about the actual theme of the Convention: harmony and integrity! Truth to tell, the theme is both timely and timeless – which is a fortuitous phenomenon, because it allows me to speak in abstract generalities without committing myself to any political positions, even if my theoretical views most certainly have practical implications. Thus, our subject is as fresh as next week’s Jewish Press or last week’s Algemeiner, and as venerably aged as any of the hoary polarities or dichotomies in our sacred tradition. Shalom and emet (or chesed and tzedek) each has claims on our attention, commitment, and loyalty – and they often pull in opposite directions. Emet, or integrity, has absolute claims, undeterred by external considerations or societal demands, while shalom, or harmony, insists upon the value of communal happiness, human survival, and mutual accommodation. Another way of putting it: integrity advocates the harmony of ideas, theories, and commitments – while harmony propounds the integrity of man, community, and society.3.The two are not only theoretical constructs, and not only values, they are also dimensions of personality, characterological factors. Harmony is favored by the irenic types, those who clamor for "unity" and are by nature compromisers, while integrity is the catchword of thosewilling to sacrifice anything and everything for "principle," the extremists. The harmony people are generally considered "soft," the integrity partisans--"hard."How do we resolve the conflict? How do we reconcile the divergent claims of שלום and אמת, each of which is itself a divine Name?There are, I believe, two grand strategies of reconciliation that I can discern in our מסורח. The Ethics and Character of Leaders - From Biblical Sources

Any discussion on “the ethics and character of presidents” is obviously a very serious contemporary undertaking. “Presidents,” after all, are a rather recent innovation, implying a democratic choice of leaders. The present essay, focusing especially on lying and truth-telling, will seek ancient sources for enlightenment, on the premise that some ethical issues are universal and ancient, and only the arrogance of modernism will lead one to dismiss the wisdom of centuries past as necessarily primitive or irrelevant. Hence, can the ancient traditions of Jewish thought teach us anything of value about the ethics of political leadership? More specifically, how can Judaic sources help to shed light on questions of presidential ethics and character in the United States? After all, these sources have their origins in ages that long pre-date either modern democracy or anything like the institution of the contemporary U.S. presidency. Indeed, the Hebrew Bible and the rabbinic tradition do not make the clear and sharp distinctions that we do today between private and public realms, or between religious and secular realms. Yet they are deeply concerned about ethical conduct and character, and some of their concerns about ethics are specific to individuals in leadership roles. Focusing on the familiar question of lying and truth- telling—when is it clearly forbidden and when, if ever, is it appropriate to lie—I suggest that the Hebrew Bible (the Torah) and the Jewish legal and ethical tradition that flows from it have a sophisticated and realistic approach to the ethics of political leadership. This approach takes careful account of the special responsibilities of public office and the special duties and prerogatives of public office-holders. However, because the sources do not focus on leaders as necessarily different from ordinary folk, it is important to mention that these sources concern lying in general. הכרת הטוב בהלכה ובמוסר היהדות (1993)

חלק ההלכה רבי סעדיה גאון לימד לנו שיטתו שהתורה תוך־תוכה שכלית, ואם ייתכן שיהיה לאדם מספיק זמן ויהיה בעל שכל עדין ועין חודרת, יש לאל ידו להגיע לכמעט כל מצוות התורה בכח שכלתו האנושית. וכשבא הגאון להדגים דבר זה, קבע שהעקרון הראשון שהשכל הבריא מעלה הוא: הכרת הטוב, הגמול לטובה שנעשה דו. ומזה נובעים הרבה מצוות, כגון: תפילה, קרבנות, כיבוד אב ואם, הלל, בהמייז וכדומה. בשעור זה נתמקד בשלש דוגמאות של הכרת הטוב, והן ברכת הגומל, ברכת מודים בשמ״ע, ואמירת מזמור לתודה בפסוקי דזמרה. ועיקר דיוננו בזה הוא מצוד. שכל-כולה הכרת הטוב, והיא ברכת הגומל. ברכת הגומל ברכה זו מקורה בברכות דף נ"ד ע״ב בסוגיא דדי צריכין להודות, ורבו גם רבו הקשיים גם בגמרא עצמה גם בראשונים, וישנם א י-אלה דיוקים וחילופי הנוסחאות בטוגיא קצרה זו שאינם אומרים אלא דרשני. למשל, שאלה פשוטה: הסוג יא עצמה מתחילה, "אמר רב יהודה אמר רב, ארבעה צריכין להודות" ומזכיר את הארבעה ומביא ראיות לכולם מתהילים ק״ז, ואחייב, "מאי מברך, אמר ר׳ יהודה, ברוך" וכוי. ומזה כנראה שרב בעצמו לא פירש איך צרי כי ן להודות ומהי ההודאה, ור׳ יהודה הוא שקובע שההודאה היא בצורת ברכה. ולכאורה היה על רב בעצמו לבאר מהי ההודאה, שהיא ברכה, ועל ר׳ יהודה למסור לנו את נוסח הברכה.1 ועוד: הרמב״ם פ״י מהלי ברכות ה״ח: ״וצריכין להודות בפני עשרה, ושנים מהם חכמים שנאמר וירוממוהו בקהל עם ובמושב זקנים יהללוהו. וכיצד מודה וכיצד מברך, עומד ביניהם (דהיינו, בין שני החכמים) ומברך בא"י אמ״ה הגומל לחייבים טובות שגמלני כל טוב." וקשה מ״ש הרמב״ם שבברכה זו "עומד ביניהם", שצריך לעמוד, ודבר זה לא נזכר בש״ס, ומהו מקורו לדין זה? והנה הנ״ל היא הגירסא ברמב״ם בדפוס שלפנינו, והכסף משנה והרבה אחרים טרחו ועמלו ליישב לשונו הכפול, "וכיצד מודה וכיצד מברך". והגרי" קאפח בפירושו למשנה תורה בהלכה זו קבע שהגירסא הנכונה היא "וכיצד מודה" ומשמיט "וכיצד מברך", וכתב שכן היא הגירטא בכל כתבי- היד. האם אפשר לקיים שניהם, או האם יש ט״ס באחת מגירסאות אלה? 1 שאלתנו היא לפי הגירסא בש״ם שלנו, הנדפס, "א״ר יהודה אמר רב", ולא לפי כ״י מינכן ואחרים המשמימים המלים "אמר רב", ועיי בד״ס על אתר. 1 hodaya2.new/Harch 28, 1993 ועוד יש חילופי גירסאות בנוסח הברכה, שבדפוס הוא "ברוך גומל חסדים טובים", וברי"ך ורא״ש וטוש״ע הוא כמ״ש הר…
