These considerations afford us the opportunity to recall that very special care must be taken in any matter relating to marriage or any situation where there exists the possibility of mamzerut, illegitimacy. Too much depends upon this, and so every precaution must be taken in advance. Hence, we must make sure that if, as often happens in the course of life, we are ever beset by a problem in this area, we always inquire of competent rabbinical authority — and the emphasis is on the word “competent.” It is unfortunate that people are sometimes innocently misled and later discover that they are involved in horrendous problems. Orthodox Jews — and, for that matter, all other Jews — must remember that rabbinic functionaries in marital matters must be fully Orthodox, experts in the area, and ethical individuals. The disqualification of those who do not fully accept the authority of Jewish Law is not a matter of pique or institutional rivalry, but of principle and law as well as common sense. Unfortunately, there are some few “Orthodox” rabbis whose credentials are questionable, and one must therefore always check carefully in advance — no less than one solicits opinions about the reputation of a dentist or a surgeon. Happily, the Rabbinical Council of America has in recent years established a fully qualified and smoothly functioning Beth Din to which most Orthodox rabbis now refer questions of ishut.These matters, about which very special care should be exercised, include divorce; remarriage or marriage of any person who has previously been married; proselytization or marrying a proselyte or a descendant of a proselyte; artificial insemination; the adoption of children, whether Jewish or non-Jewish. The problems that exist in such cases can be enormous; most of the unhappy consequences are avoidable if we are wise enough to inquire before proceeding impulsively.The Torah is the center of our lives as individuals and as a people. The Halakhic Person and the Halakhic Process: Excerpts of the Concluding Portion of the Sheur Klali (1997)

His Personality: Civility. It emerges from the responsum that is the subject of this sheur that the local Rav, who referred the problem to R. Isaac Elchanan, had made a mistake; had he given the elderly couple who turned to him for guidance the right advice, the problem that so distressed the wife after her husband’s demise would never have arisen. Yet note how civil, even respectful, R. Isaac Elchanan is of this anonymous Rav: First—he lets him remain anonymous; he has no interest in exposing him to the opprobrium of his colleagues. Second, he does not insult him—no calling him an am ha-aretz, and no blistering attack demanding that he should have consulted him as a higher authority; and third, a special effort to interpret his actions in a favorable light. This is how a true gadol be’Yisrael acts—and how we too should conduct ourselves. The Halakhic Process. An important lesson to be learned from analysis of this responsum of R. Isaac Elchanan concerns the nature of the whole halakhic method. To put it into somewhat extreme forms, abandoning subtlety for the sake of clarity, there are two competing points of view: a) the halakhic process is totally objective and univocal; our purpose is but to discover the single halakhic truth, and to approach the question at hand utterly without prejudice or bias. b) the Halakha is what we want it to be; it is the formal dressing for rabbinic policy, whether explicit or implicit, conscious or unconscious. The responsum we studied belies both of these conflicting theses—each in a different way. The second view, that the Rabbis can make of the Halakha whatever they wish, is not only inconsistent with the whole history of Halakha, but it is pernicious in that it contradicts the most basic assumptions of the Halakha. It assumes an almost infinite plasticity on the part of the Halakha, and bears within itself serious antinomian consequences. הדיון המרכז לענין זה הוא שמסופר התלמוד (סנהדרין ל"ז ע"ב, שבועות ל"ד ע"א) על התנא הקדוש רבי שמעון בן שטח: תניא: אמר רבי שמעון בן שטח, אראה בנחמה אם לא ראיתי אחד שרץ אחר חבירו לחורבה ורצתי אחריו וראיתי סייף בידו ודמו מטפטף והרוג מפרפר, ואמרתי לו, רשע מי הרגו לזה או אני או אתה אבל מה אעשה שאין דמך מסור בידי שהרי אמרה תורה יעל פי שנים עדים יומת המת, היודע מחשבות יפרע מאותו האיש שהרג את חבירו, אמרו לא זזו משם עד שבא נחש והכישו ומת.כאן אנו עומדים מול התנגשות בין ידיעתו העובדתית של האמת והצדק ע״י הדיין לבין התמסרותו הקפדנית למשפט שהינו גלום בהלכה הפורמאלית.תחילה עלינו להבדיל בין ד"מ לד״נ. מהמסופר על שמעון בן שטח ברור שבדיני נפשות יד המשפט עליונה על יד האמת, ההלכה הפורמאלית מכריעה את החופש של הדיין בבקשתו את האמת העובדתית. וזה ודאי בזכות הזהירות היתירה כשחיי אדם תלויים בפסק הדיין או הסנהדרין, וכן משמע מדברי הרמב"ם בפ"ב מהלי סנהדרין ה״א, וזייל: "אין בית דין עונשין באומד הדעת, ועל זה נאמר נקי וצדיק אל תהרוג," שמזה משמע שזה חידוש, כלומר, שהכלל הנורמטיבי הוא אומדנא, רק בנייד חידשה התורה שמוטב שהרשע יצא חפשי עפ״י חוקי ההלכה, ולא להכניס את הדיין לעסק בו יכול לגרום למיתת צדיק ונקי בדיוניו עפ״י אומדנא.אבל לפנינו שתי בעיות:א) האם זה מוסכם לכל הדעות בדיני נפשות? ב) האם שונה הדין לגבי דיני ממונות?על זה יש סוגיות מחולקות בין סנהדרין ל"ז ע"ב לשבועות לייד ע"א. התוס' בשני המקומות כבר נגעו בזה וניסו לתרץ. לפי המשנה בסנהדרין לייז ע״א, על הדיינים להזהיר את העדים לבל ישתמשו באומד הדעת בעדותם. והגמ' בעייב שם: "תנו רבנן: כיצד מאומד?... בדיני נפשות הוא דלא אמדינן, הא בדיני ממונות אמדינן. כמאן? כרבי אחא. דתניא: רבי אחא אומר, גמל האוחר בין הגמלים, ונמצא גמל הרוג בצידו, בידוע שזה הרגו." (בהלכה. "אומדנא" כולל גם ' circumstantial evidence) והתוס' בסנהדרין ד"ה כמאן כרי אחא, וז״ל: "משמע דרבי אחא לית ליה אומד בדיני נפשות, ותימה דבפרק שבעות העדות (שבועות לייד ע״א ושם) משמע דאית ליה גבי שבועת העדות דאינו חייב אלא בתביעת ממון." א"כ מכאן דרבי אחא ודאי ס"ל שיש אומדנא בד״מ, וייתכן שסובי שיש אומדנא גם בד"ני שלא שמעון בן שטח. והנה זה מוסכם שאין הלכה כרבי אחא, ולפיכך המסקנה היא שאין אומד דעת בד״נ. ולכאורה, כיון…
